What Is Probate?
Probate is the legal process that takes place after someone dies. It involves validating a will (if there is one), identifying assets, paying off debts and taxes, and eventually distributing what’s left to the rightful heirs. The full probate process can take several months—sometimes over a year—and come with considerable legal costs.
But here’s what many people don’t realize: not all estates have to go through full probate.
If the estate is considered “small” under your state’s guidelines, you may qualify for simplified procedures that drastically reduce the time, expense, and paperwork involved.
What Qualifies as a Small Estate?
In California, for example, if the value of the estate is under $184,500, and there is no real property (like a home), you may be able to skip court entirely using a Small Estate Affidavit. This document can be used to claim bank accounts, vehicles, and personal property without hiring an attorney or filing a probate petition.
If there is real estate involved, or the property is under a separate threshold (currently $61,500 for real property), there are still summary probate options that allow for faster court processing. And if you’re a surviving spouse, the law allows for an even simpler procedure through a Spousal Property Petition, which avoids full probate altogether.
Why This Matters
Here’s a story I’ve seen play out far too often: A son inherits his mother’s modest estate—her car, some personal items, and a checking account with $15,000. No will, no trust. He waits months thinking the process will be complicated or costly. In the meantime, the bank account gets frozen, the car can’t be registered, and bills pile up.
All of this could’ve been avoided with a simple affidavit filed 40 days after death—no court, no attorney, no delays.
